Weekly Working Hours

Regular working hours are limited to maximum of 40 hours per week, plus rest breaks, and 9 hours per day. Where overtime is worked, the working hours must not exceed 13 hours per day and 48 hours per week. In respect of any overtime work, the employee must be paid their normal salary plus a premium of 40%. Alternatively, there can be an agreement whereby the employee is compensated by equivalent time off in lieu on agreed dates, plus the pay premium of 40%.

Probationary Periods

The probationary period is up to 6 months long.

Termination Notice

The probation period is 14 days. For employees with less than 5 years of employment, the notice period is 1 month. Employees with more than 5 years but less than 10 years of employment are required to give a 2-month notice. For employees with over 10 years of employment, the notice period ranges from 3 to 6 months, depending on the employee’s age. These notice periods may vary according to the Collective Bargaining Agreement.

Severance

There is no legal mandate for severence pay on a standard termination of employment. However, there may be specific situations where employees may become eligible for severence payments. If applicable and the employee becomes entitled to a severence payment this will be determined by a Collective Bargaining Agreement or a termination agreement with a negotiated severence between the parties.

Pre-hire Checks

Immigration and right to work checks are required for employees. Credit checks can be conducted if justified by the role, with the employee’s consent. Criminal record checks may be required if justified by the role and statutory obligations. Pregnancy tests are prohibited by law. Health screening is allowed only in limited circumstances with the employee’s consent. Drug and alcohol testing is permitted only in specific roles mandated by statute, particularly where there is a need to protect life or health.
